Campaign “Generatie Plantrekkers / Génération Débrouille feat. Camille Yembe”
These terms apply between TIE BREAK SAS, 61, rue de Turenne, 75003 Paris, France, company number 930 876 305 (“TIE BREAK”), together with PAFFF MUSIC BV, Avenue des Coteaux, 14/301, 1480 Tubize, Belgium, company number 0843.782.214 (“PAFFF MUSIC”), (together “PAFFF”), and the person who participates and accepts them (the “Participant”).
Camille Yembe, TIE BREAK in co-production with PAFFF, together with Telenet Group NV (“BASE”), organize the campaign “Generatie Plantrekkers feat. Camille Yembe” (the “Campaign”), in which a musical work, a single and a music video are created.
By ticking the box provided for that purpose, the Participant declares that they have read and accept these terms and the participation terms of the Campaign (the “Video Rules”). The agreement between TIE BREAK and PAFFF and the Participant is concluded at that moment. No signature is required.
1.1. These Video Rules govern the Participant’s participation in the filming of a music video illustrating the recording entitled “Tout est facile”, the filming of which will take place in Brussels (Belgium) on 6 September 2026 (“Video”) and the rights relating thereto. The Video means the final version videoclip and any related footage or versions. These Rules do not apply to the Additional Content created in the context of the Campaign, which are governed separately. These Rules, however, also govern the processing of the Participant’s personal data by TIE BREAK and PAFFF MUSIC in the context of the production, use, publication, dissemination and promotion of the Video, which may include Additional Content.
1.2. “Additional Content” means all image, sound and photographic material created in the context of the Campaign, including photos, behind-the-scenes material, interviews and stories, recorded by the Participant themselves, including with their own device, whether it does or does not form part of the Video.
2.1. The Participant cooperates voluntarily. When on set, the Participant must follow the instructions of the director and the production crew regarding safety, practical production organization, recording locations, timing and duration, and privacy and image rights, etc. Acceptance of these Video Rules does not create an employment contract or a relationship of authority.
2.2. Participation does not entitle the Participant to the inclusion in the final Video or mention in any communication of PAFFF or the Campaign.
3.1. The Participant grants PAFFF an irrevocable, worldwide licence for the full duration of the relevant intellectual property rights and neighbouring rights to exploit the Video and related material for the commercial and promotional purposes of TIE BREAK and PAFFF MUSIC, its affiliated companies and third-party partners of TIE BREAK and PAFFF MUSIC, whether or not in the context of the Campaign.
The licence expressly includes:
• reproduction on all media, analogue and digital;
• communication to the public via social media, websites, radio, television, advertising and point-of-sale material;
• adaptation, montage, editing, fragmentation, subtitling, translation and synchronisation, it being understood that the contribution may thereby be adapted, shortened or used only partially;
• the right to grant sublicences, in whole or in part, to CY’s campaign partners.
Participant grants the same rights to BASE.
3.2. The licence is exclusive for commercial and promotional exploitation.
3.3. The Participant does not waive their moral rights but will not exercise them in a way that prevents the exploitation referred to above. The Participant agrees to the aforementioned edits and that their name may not be mentioned. PAFFF is not obliged to exploit the Video.
4.1. The Participant hereby expressly authorizes PAFFF to use, publish, reproduce and disseminate their name, artist name, likeness, voice and image, as contained in the Video, in any form and by any means, worldwide and in all media, in the context of the PAFFF commercial and promotional communications, for the entire period during which Video is exploited.
4.2. The Participant hereby expressly authorises PAFFF, in the context of the Campaign, to make or have made their likeness, in any form and by any means, by PAFFF or by third parties instructed by PAFFF, such as a production company or creative support companies.
4.3. The Participant agrees that PAFFF may adapt, modify and edit, or have adapted, modified and edited, the footage.
5.1. Participation is voluntary. Since the Video is exploited exclusively for marketing and promotional purposes, the Participant receives no remuneration from PAFFF for this.
5.2. [Only for the musical talent] The Parties confirm that the fixed remuneration per studio day and the royalty share that the Participant receives under their agreement with TIE BREAK and/or PAFFF MUSIC also constitute consideration for the grant of rights under these Video Rules and, taken as a whole, constitute appropriate and proportionate remuneration.
6.1. The Participant declares that they are 18 years of age or older.
6.2. The Participant shall not use TIE BREAK or PAFFF MUSIC trademarks and trade names and shall not publicly refer to the cooperation without prior consent, except for the mere mention of their participation. The Participant refrains from public statements that could portray the TIE BREAK or PAFFF MUSIC brands in a negative light and may not publish any unreleased materials before that launch.
7.1. Participants’ personal data, as set out in clause 7.2, may be processed by TIE BREAK and PAFFF MUSIC, who are each involved in the production, editing, storage, exploitation and distribution of the Video. They are acting as controllers for the personal data.
7.2. By participating in the recording of the Video, the Participant acknowledges that TIE BREAK and PAFFF MUSIC may process the following categories of personal data: the images of the Participants, voice, video and their likeness, and Additional Content submitted by the Participants, which may contain Participant’s image, voice, video and likeness, and which can be incorporated in the Video.
7.3. Personal data will be processed by TIE BREAK and/or PAFFF for the purposes of production, publication, distribution and promotion of the Video and, depending on the processing activity concerned, on the basis of the performance of this agreement, compliance with legal obligations, the legitimate interests of TIE BREAK and/or PAFFF in producing, promoting and distributing the Video, and, where legally required, the Participant’s consent.
7.4. Participants’ personal data, as contained in the Video, may be shared with or collected by PAFFF’s production partners and service providers for the purposes of the Campaign, as well as shared with BASE which processes personal data as an independent controller, for the purpose of receipt, use, publication and promotion of the Video and the Additional Content by BASE via BASE’s communication channels.
7.5. TIE BREAK and PAFFF MUSIC will not retain personal data for longer than necessary for the purposes for which they were collected. However, the Video may remain publicly available and continue to be exploited for as long as TIE BREAK and PAFFF MUSIC continue to exercise the rights granted to them in relation to such content.
7.6. The Video may be published and distributed worldwide via television, social media, streaming services and other media channels. As a result, personal data included in the Video may be transferred or made accessible worldwide, including in countries outside the European Economic Area. Third-party online platforms and media services, such as Facebook, Spotify, YouTube, etc., act as independent controllers and process personal data in accordance with their own terms and privacy policies.
7.7. Participants may exercise their rights in accordance with applicable data protection legislation. Participants acknowledge, however, that the Video constitutes an artistic and audiovisual work and that certain rights may be limited to the extent permitted under applicable law as necessary to safeguard freedom of artistic expression, intellectual property rights or the integrity of the Video. Requests by Participants to delete, port, modify or restrict access to their personal data included in the Video may therefore not always be granted if this would disproportionately affect the production, publication, distribution or exploitation of the Video.
7.8. For complaints relating to the processing of personal data by PAFFF MUSIC, Participants may contact the Belgian Data Protection Authority via https://www.gegevensbeschermingsautoriteit.be/burger/acties/klachtindienen. For complaints relating to the processing of personal data by TIE BREAK, Participants may contact the French National Commission on Information Technologies and Liberties (CNIL) https://www.cnil.fr/en/plaintes. BASE’ processing of Participants’ personal data is described in the BASE privacy policy available at https://www.base.be/en/legal-information/privacy-policy.html and Additional Content Rules as entered into between BASE and the Participant.
8.1. These Rules enter into force at the moment of acceptance by the Participant and end upon completion of the Campaign. Articles 3, 4, 6, 7 and 8 remain in force thereafter, where applicable for the duration specified therein. PAFFF may modify, postpone or discontinue the Campaign without this giving rise to any right to compensation.
8.2. The Video Rules remain fully applicable to the Participant’s participation in the Video; in the event of conflict, these Video Rules prevail. The Video Rules apply independently and remain applicable even if acceptance of the Rules cannot be demonstrated or would have no effect.
8.3. The invalidity of any provision does not affect the remaining provisions. Belgian law applies and the courts of Mechelen have exclusive jurisdiction. Electronic acceptance is recognised as legally valid.
