ADDITIONAL CONTENT TERMS

Campaign “Generatie Plantrekkers / Génération Débrouille feat. Camille Yembe”

Acceptance

These terms apply between TELENET GROUP NV, Liersesteenweg 4, 2800 Mechelen, company number 0462.925.669 (“BASE”), and the person who participates in and accepts them (the “Participant”).

BASE organises the campaign “Generatie Plantrekkers feat. Camille Yembe” (the “Campaign”), together with Camille Yembe and her label PAFFF Music SRL and TIE BREAK (together referred to as “PAFFF” for the purpose of these Rules), in which a musical work, a single and a music video (the “Video”) are created.

By ticking the box provided for that purpose, the Participant declares that they have read and accept these terms and the participation terms of the Campaign (the “Rules”).

The agreement between BASE and the Participant is concluded at that moment. No signature is required.

1. Subject matter

1.1. “Additional Content” means all image, sound and photographic material created in the context of the Campaign and which does not form part of the recording, the Video or the artwork, including photos, behind-the-scenes material, interviews and stories, regardless of whether this was recorded by or on behalf of BASE or by the Participant themselves, including with their own device.

1.2. These Rules govern the Participant’s cooperation in the creation of Additional Content and the rights relating thereto. These Rules also govern the processing by BASE of the Participant’s personal data processed in the context of the production, use, publication, dissemination and promotion of the Video and the Additional Content. These Rules do not apply to the musical work, the recording, the Video or the artwork, which are governed separately.

2. Cooperation

2.1. The Participant cooperates voluntarily. When creating Additional Content during the recordings, the Participant follows the instructions of the director and the production crew regarding safety, practical production organisation, recording locations, timing and duration, and privacy and image rights. Acceptance of these Rules does not create an employment contract or a relationship of authority. If specific moments of availability are agreed, BASE will communicate them in good time and will take reasonable account of the Participant’s schedule.

2.2. Participation does not entitle the Participant to the inclusion or use of their contribution in any communication of BASE or the Campaign.

3. Rights to the Additional Content 

3.1. The Participant grants BASE an irrevocable, worldwide licence for the full duration of the relevant intellectual property rights and neighbouring rights to exploit the Additional Content for the marketing and promotional purposes of BASE and its affiliated companies, whether or not in the context of the Campaign. The licence expressly includes:

• reproduction on all media, analogue and digital;
• communication to the public via social media, websites, radio, television, advertising and point-of-sale material;
• adaptation, montage, editing, fragmentation, subtitling, translation and synchronisation, it being understood that the contribution may thereby be adapted, shortened or used only partially;
• the right to grant sublicences, in whole or in part, to BASE’s campaign partners.

3.2. If Additional Content is integrated, in whole or in part, into the Video or into another communication exploited by PAFFF, the Participant grants the same rights to PAFFF. The Participant acknowledges that such integration is irreversible and that the relevant content cannot be withdrawn after dissemination.

3.3. The licence is exclusive for commercial exploitation. After publication by BASE, the Participant may share Additional Content in which they appear or which they recorded themselves via their own channels for personal, non-commercial purposes. The Participant may under no circumstances:

• publish or otherwise make the Additional Content available via platforms, websites or services primarily intended for adult content, sexually explicit content or similar purposes;
• use the Additional Content in a manner that is unlawful, defamatory, misleading, offensive or discriminatory, or that is harmful to the reputation, goodwill or interests of BASE, the Campaign or any third party;
• use artificial intelligence or similar technologies to generate, manipulate, process or modify the Additional Content that they provide to BASE;
• use, upload or otherwise make available the Additional Content or any part thereof for the training, testing or development of artificial intelligence systems.

3.4. The Participant does not waive their moral rights, but will not exercise them in a way that prevents the exploitation referred to above. The Participant agrees to the aforementioned edits and to the possibility that their name may not be mentioned with every use. BASE is not obliged to exploit the Additional Content.

3.5. Material that the Participant provides to BASE, the producer or a campaign partner via WhatsApp or any other digital channel automatically falls under these Rules from the moment it is sent.

4. Name and likeness

4.1. The Participant hereby expressly authorises BASE to use, publish, reproduce and disseminate their name, artist name, likeness, voice and image, as contained in the Additional Content, in any form and by any means, worldwide and in all media, in the context of the creation of BASE’s marketing and promotional communications. This authorisation applies for the duration of the Campaign and for 5 years thereafter. After that period, BASE will no longer use the likeness in new campaign communications; already published content and archive material may remain online.

4.2. The Participant hereby expressly authorises BASE, in the context of the Campaign, to make or have made their likeness, in any form and by any means, by BASE or by third parties instructed by BASE, such as an advertising agency or production company.

4.3. The aforementioned authorisation relates in particular, but not exclusively, to the photos and film recordings made on 6 September 2026 in Brussels in which the Participant’s likeness appears, including their name, video recording, voice, image and interview.

4.4. The Participant agrees that BASE may adapt, modify and edit, or have adapted, modified and edited, the recordings referred to in Article 4.3 above and, where applicable, the production, and may add or have added images at its discretion.

5. Remuneration

5.1. Participation is voluntary. Since the Additional Content is exploited exclusively for marketing and promotional purposes, the Participant receives no remuneration from BASE for this. Travel and accommodation expenses approved in advance in writing will be reimbursed upon presentation of supporting documents.

5.2. [Only for the musical talent] The Parties confirm that the fixed remuneration per studio day and the royalty share that the Participant receives under their agreement with PAFFF also constitute consideration for the grant of rights under these Rules and, taken as a whole, constitute appropriate and proportionate remuneration.

6. Warranties and obligations

6.1. The Participant declares that they are 18 years of age or older, that their contribution is original and that they hold all necessary rights. If the Participant provides image or sound material themselves, they further warrant that it does not contain any music, artworks, trademarks or other protected third-party elements. For Participants who are recognisable on screen or audible, the consent granted under these Rules applies. If other persons are recognisable on screen or audible in the Additional Content, the Participant warrants that they have all required consents and rights to make this Additional Content available to BASE and to allow BASE to use it in accordance with these Rules. The Participant indemnifies BASE, its campaign partners, Camille Yembe and PAFFF against third-party claims arising from any breach of the foregoing.

6.2. The Participant does not use BASE’s trademarks and trade names and does not publicly refer to the cooperation without prior consent, except for the mere mention of their participation after the public launch. The Participant refrains from public statements that could portray the BASE brand in a negative light and does not publish any Additional Content before that launch.

7. Personal data

7.1. BASE is a controller for the personal data it processes in the context of the Campaign for the organisation and management of the Campaign and participation in the Video, as well as for the receipt, use, publication and promotion of the Video and the Additional Content by BASE via BASE’s communication channels. PAFFF is a controller for the personal data it processes in the context of the Campaign for the production, recording, editing and storage of the Video and the Additional Content, as well as for their publication, distribution and promotion by PAFFF via PAFFF’s communication channels. PAFFF processes personal data in accordance with PAFFF’s privacy policy and/or other applicable agreements between PAFFF and the Participants. BASE and PAFFF each act as independent controllers for their respective processing activities.

7.2. By participating in the recording of the Video, the Participant acknowledges that BASE may process the following categories of personal data:

(a) administrative data provided by the Participant to BASE, including name, contact details, any dietary preferences for the organisation of catering, as well as records of attendance and acceptance of these Rules;

(b) the Participant’s image, voice, likeness and video recordings as filmed by PAFFF and incorporated into the Video;

(c) the Participant’s image, voice, likeness and video recordings insofar as they are contained in Additional Content recorded on set by other Participants during the recording of the Video and subsequently provided to BASE or its production partners in accordance with these Rules; and

(d) all Additional Content that the Participant records and submits to BASE or its production partners.

7.3. Participants acknowledge and agree that Additional Content created by other Participants may contain their image, voice, likeness and video recording and may be incorporated in the Video or used by BASE in accordance with these Rules. Participants may not intentionally film or photograph members of the public, production staff or other persons who are not Participants on set, unless they have obtained consent to do so.

7.4. Participation in the Video and submission of Additional Content are voluntary. Personal data are processed for the organisation, production, publication, distribution and promotion of the Video and the Additional Content and, depending on the processing activity concerned, on the basis of the performance of these Rules, compliance with legal obligations, the legitimate interests of BASE and/or PAFFF in producing, promoting and distributing the Video and the Additional Content, and, where legally required, the Participant’s consent.

7.5. Participants’ personal data may be shared with BASE’s production partners and service providers, including Wave Agency NV and Medialife BV, which process personal data on behalf of BASE under appropriate contractual and organisational safeguards for the purposes of the Campaign, as well as with PAFFF, which processes personal data as an independent controller.

7.6. BASE will not retain personal data for longer than necessary for the purposes for which they were collected. Catering data will be deleted as soon as possible and in any event within 30 days after the filming event. Records evidencing the Participant’s attendance and acceptance of these Rules and the rights granted therein may be retained during the exploitation of the Video and the Additional Content and thereafter for as long as necessary for evidentiary, compliance, archiving and legal claim purposes. The Video and other published Additional Content may remain publicly available and continue to be exploited for as long as PAFFF and/or BASE continue to exercise the rights granted to them in relation to such content.

7.7. The Video and the Additional Content may be published and distributed worldwide via television, social media, streaming services and other media channels. As a result, personal data included in the Video and the Additional Content may be transferred or made accessible worldwide, including in countries outside the European Economic Area. Third-party online platforms and media services, such as Facebook, Spotify, YouTube, etc., act as independent controllers and process personal data in accordance with their own terms and privacy policies. BASE will not transfer data relating to the participation management, including Participants’ contact details, to such online media platforms and will process and retain these data separately in accordance with BASE’s Privacy Policy.

7.8. Participants may exercise their rights in accordance with applicable data protection legislation. Participants acknowledge, however, that the Video and the Additional Content constitute an artistic and audiovisual work and that certain rights may be limited to the extent permitted under applicable law and necessary to safeguard freedom of artistic expression, intellectual property rights or the integrity of the Video or Additional Content. Requests by Participants to delete, modify or restrict access to their personal data included in the Video or Additional Content may therefore not always be granted if this would disproportionately affect the production, publication, distribution or exploitation of the Video, the Additional Content or related material.

7.9. Any publication of Additional Content by a Participant via their own social media channels is carried out independently by that Participant and not on behalf of BASE. The Participant remains solely responsible for such publication and for compliance with applicable legislation, including any obligations applicable to them as a controller.

7.10. Questions about the processing of personal data by BASE may be addressed to privacy@telenetgroup.be. For complaints relating to the processing of personal data by BASE, Participants may contact the Data Protection Authority via https://www.gegevensbeschermingsautoriteit.be/burger/acties/klachtindienen.

For questions about the processing of Participants’ personal data by PAFFF, Participants may contact PAFFF.

8. Final provisions

8.1. These Rules enter into force at the moment of acceptance by the Participant and end upon completion of the Campaign. Articles 3, 4, 6, 7 and 8 remain in force thereafter, where applicable for the duration specified therein. BASE may modify, postpone or discontinue the Campaign without this giving rise to any right to compensation.

8.2. The Rules remain fully applicable; in the event of conflict, these Rules prevail. The Rules apply independently and remain applicable if acceptance of the Rules cannot be demonstrated or would have no effect.

8.3. The invalidity of any provision does not affect the remaining provisions. Belgian law applies and the courts of Mechelen have exclusive jurisdiction. Electronic acceptance is recognised as legally valid.
