I. CONTEST RULES

ARTICLE 1 - Introduction

TELENET GROUP NV (trading under the trade name BASE) (hereinafter referred to as 'the Organizer'), whose registered office is at Liersesteenweg 4, 2800 Mechelen, is organizing a campaign on its BASE.be website around [winning back the cost of your smartphone]. The Competition runs from [11/01/2021] (0.01 a.m.) to [24/01/2021] (11.59 p.m.).

The Organizer has the right to unilaterally change the end date of the Competition. These rules set out the general terms and conditions of participation that apply to this Competition. Additional guidelines are a part of the competition rules.

For the organization of the competition game, the Organizer shall use the services of LuckyCycle SA/NV (hereinafter ‘LuckyCycle’), a public limited company (naamloze vennootschap), incorporated under Belgian law, registered with the Crossroads Bank for Enterprises under number 0548 756 417, RLE Brussels, having its registered office at Avenue Louise 523, 1050 Brussels.

From 11/01/2021 up to and including 24/01/2021, on www.BASE.be, the Organizer will:

• Give away 1 handset per day
• A total of 14 handsets will be given away from 11/01/2021 to 24/01/2021.
• Only valid on BASE for joint offers starting from BASE 20
• The promotion is valid for a selection of high-end handset devices (promotional price > € 150)
• The Cashback is only valid after activation of the SIM card and the 14-day revocation/exchange period.

• Week 1: 04/01/2021 to 10/01/2021 inclusive

  • Registration to receive a reminder e-mail as soon as game life goes live via BASE.be

• Weeks 2 - 3: 11/01/2021 to 24/01/2021 inclusive
  • 14 handsets (1 handset/day) with a value of at least € 150, depending on the handset purchased by the consumer. A total of 14 winners will receive a handset cashback if they have won via notification on the website and via a confirmation e-mail.

ARTICLE 2 - Acceptance of the Regulations

The mere participation in this Competition implies the acceptance of the present rules without any reservations. No disputes will be taken into consideration in this respect.

ARTICLE 3 - Conditions for participation

Participation in the Competition is open to anyone who is a customer of the Organizer at the time of participation (i.e. who purchases a BASE Handset during the period of the competition, from 11/01/2021 to 24/01/2021).

In order to be able to participate on BASE.be, the participant must satisfy the following conditions: has taken a subscription to BASE 20 and has bought a handset at a promotional price > € 150 on BASE.BE. Every registration counts as participation and is recorded as such.

Participation in the Competition is prohibited for workers of the Organizer and LuckyCycle, for all direct or indirect employees of the Organizer and LuckyCycle and for all those who have contributed to the organization of this Competition.

Family members in the first and second degree of the persons referred to in the above paragraph, and the persons residing under the same roof as the latter shall also be excluded from the right to take part in this Competition.

The participation of a minor (under 16 years of age) requires the consent of a parent or guardian. BASE is authorized to ask for proof of this.

Each entrant may take part in the Competition a maximum of 3 times, but only if a purchase of a new device is made each time. 1 transaction (purchase of 1 device combined with subscription from BASE 20) counts as 1 participation. Each participant can win 3 times but only if a purchase of a new device is made 3 times, and thereby win back the value of his smartphone once via a cashback.

The participant must have fulfilled all his commitments with regard to the Organizer, and must not be in arrears with the Organizer.

The Organizer may at any time exclude a person from participation in the Competition, or may decide not to award a prize to a winner in the event of a breach of any of the terms and conditions of participation or in the event of abuse, deception or participation in the Competition in bad faith.

The guarantees given on our products and after-sales services remain valid when participating in the competition.

ARTICLE 4 - Course of the Competition

Participation in the Competition must take place between the dates set out in Article 1: from Monday 11/01/2021 to Sunday 24/01/2021 inclusive. Only participations registered between the two dates will be allowed.

Once the participant has purchased a handset of at least € 150 combined with a subscription to at least one BASE 20, he will be invited to take part in the competition game by clicking on the ‘Play now’ button on the pop-in displayed on the confirmation page. The entrant must accept these Competition Rules, fill in his e-mail address and answer a question that relates to his understanding, his general culture or his knowledge of the Organizer's products (hereinafter the ‘Competition Question’) before gaining access to the game. Participation in the Competition is free of charge, but is only eligible upon the purchase of a joint offer with a handset belonging to this campaign and upon payment of the products purchased on the Organizer's website.

Each participant declares that he/she has read and accepted the complete rules and principles of the game.

If the participant has won the Competition, he/she must share additional personal information in order to obtain his/her winnings, namely his/her surname, first name, telephone number and bank account number.

This competition does not constitute a game of chance within the meaning of the Law of 7 May 1999 on games of chance, gaming establishments and the protection of players. Nor is it a lottery within the meaning of Article 301 of the Penal Code.

Participants who have answered the Competition question correctly may take part in the grabbing game. The selection will take place immediately, randomly and without human intervention, using computer technology. The day winner will be selected from the group of participants on the basis of the correct answer to the Competition and the automatic mechanism of the gripping game.

Each participation has the chance of a refund of the purchase price of the handset, including VAT. Over the entire duration set out in Article 1, the game offers a refund of 1 handset per day, for each day of the duration of the game.

Both winners and losers will be notified immediately on the Organizer's website.

ARTICLE 5 - The Prize

The winners will receive a full refund of the purchase price of their handset bought from the joint offer that is eligible for the Competition. This refund will take place after the activation of the SIM card and the expiry of the right of withdrawal (14 days after delivery), and within a period of 60 days from the participation, provided that the information provided to the Organizer is correct. The participant shall be deemed to have definitively and irrevocably forfeited his prize if he/she fails to provide his/her details within 5 days of the date of participation.

The prize cannot be paid out in cash or be exchanged for another prize. The price is indivisible and must be accepted as such. Nor may it be resold to third parties. Reimbursement shall be made by the Organizer.

ARTICLE 6 - Liability

The Organizer and/or LuckyCycle cannot be held liable by the participants for any loss or damage of any kind suffered in connection with the Competition under any circumstances and upon any legal basis, except in the event of willful misconduct or gross negligence on the part of the Organizer. This provision also applies to direct or indirect damage that may result from a faulty connection to the website www.base.be and, if applicable, its mobile application and/or the computers in the shops and/or e-mail systems. Each participant is obliged to take the necessary measures to protect his own data and/or the software included in his computer equipment and/or his website against possible attacks. The connection to the website www.base.be, as well as the participation in the competition game, are entirely the responsibility of the participants.

The participants agree that their identity and place of residence will be verified. Any false identity or a false address will result in the exclusion of the participant from the competition.

In general, any violation of the rules and regulations, and any attempt at fraud and/or deception will be punished with the immediate exclusion of the participant.

ARTICLE 7 - Processing of personal data

By communicating his personal data, the participant declares that the information provided is true, correct, complete and up-to-date.

The personal data that you provide by registering for this Competition and participating in the Competition will be included in the files of Telenet Group NV (trading under the commercial name BASE), whose registered office is at Liersesteenweg 4, 2800 Mechelen, with KBO number 0462 925 669 (hereinafter referred to as "BASE"), which is responsible for processing.

Your personal data will be processed as set out in the BASE privacy policy (https://www.BASE.be/nl/wettelijke-informatie/privacybeleid.html).

To make this competition possible, the Organizer is using the services of LuckyCycle. LuckyCycle will thereby process any personal data necessary for the organization and smooth running of the competition, as well as for any award and presentation of the prize. LuckyCycle will only process this data for the purposes of this competition, and will delete it after the competition.

You have the right to ask BASE to allow you to inspect the personal data relating to you, and to have it corrected, deleted or transferred. You can exercise these rights via the BASE Customer Area (for BASE customers only) and the BASE shops. In the shop, you must first provide proof of your identity, preferably by means of a copy of the front of your identity card.

ARTICLE 8 - Complaints

Any complaint relating to this Competition must be sent to the Organizer in writing, addressed to the Legal Department at the address given in Article 1, within 7 working days of the facts. Under no circumstances shall complaints be dealt with verbally or by telephone. Complaints submitted outside of the deadline or that are not made in writing will not be dealt with.

ARTICLE 9 - Miscellaneous

If one of the provisions of these regulations is declared null and void or inapplicable, the remaining provisions shall remain in full force and effect. This condition shall apply to the extent permitted by law.

Each participant in the Competition shall be deemed to have taken note of and accepted the features and restrictions relating to the use of the Internet. The Organizer and/or LuckyCycle shall not be liable under any circumstances for:

• the malfunctioning of the Internet and/or the software used;
• the consequences of viruses, bugs, anomalies, technical deficiencies;
• technical defects, defects of the hardware or software of any kind.

This Competition has been placed under the supervision of the Organizer.

The Organizer reserves the right to modify, postpone, curtail or revoke the Competition or any part thereof as circumstances require. The Organizer may not be held liable in this respect.

Printing, spelling, typesetting or other errors cannot be invoked as grounds for any obligation whatsoever.

These regulations are subject to Belgian law, and any dispute relating to their interpretation or application falls under the jurisdiction of the courts of the judicial district of Antwerp, department Mechelen.
